General Terms & Conditions
1) Access to any information on the Mad-Bike Madrid Web Site is
conditional on the acceptance of the following Legal Information. If
you do not wish to accept any part of this Legal Information, you
must not use our Web Site.
2) References on the Web Site to “we”, “our” and “us” are references
to Mad-Bike Madrid
3) Our Web Site does not contain all the information relevant to any
tour or travel arrangements you may book with us. In particular, all
bookings are subject to our applicable booking conditions. All
bookings are subject to the general information applicable in each
instance. You must obtain a copy of our applicable booking
conditions and this additional information together with all other
relevant details relating to your chosen tour or travel arrangements
prior to making a booking with us.
4) No warranties, promises and/or representations of any kind,
express or implied, are given as to the accuracy of any of the
information contained on our Web Site or as to the nature, standard,
suitability or otherwise of any services offered by us or on our
behalf. We shall not be liable for any loss or damage of whatever
nature (direct, indirect, consequential or other) which may arise as
a result, directly or indirectly, from the use of any of the
information or material contained in our Web Site and/or use of or
access to any other information or material via web links from our
site or any inability to access or use of our Web Site.
5) The information shown on the Web Site is updated from time to
time and therefore may have changed by the time you come to book
your tour. Whilst every effort is made to ensure the accuracy of all
such information and prices, regrettably errors do occasionally
occur. You must therefore ensure you check all details of your
chosen tour (including the price) at the time of booking.
6) The copyright of the material contained on the web site belongs
to Mad-Bike Madrid unless otherwise stated.
Booking Terms and Conditions
1. You can book a tour in writing, by phone or via email.
Only after receiving of a 30% reservation payment (for groups >20)
and/or a written confirmation of your booking by Mad-Bike Madrid (or
one of our representatives) does the contract become effective.
Participation for all tours is only possible after accepting the
terms and conditions on our booking form or by signing a Mad-Bike
Madrid non-liability declaration before the start of a tour. Upon
request we will send you the non-liability declaration before you
book the tour.
2. Deposit - Outstanding Payment
Immediately after payment of the 30% deposit we will process the
completion of the contract (receipt of the booking confirmation).
The outstanding payment is to be made to Mad-Bike Madrid no later
than 4 weeks prior to the start of the tour. (for groups >20).
For all smaller groups we offer the possibility to pay the full
balance on the actual tour date, the total amount of the outstanding
balance will be made to one of our representatives/guides present at
the spot before the start of your
tour.
3. Service and Price
The services included in the tour price can be found in the tour
description.
4. Services
Any changes regarding the services offered on our website (or any
description in written form) will be disclosed to you without delay.
Changes in the driving routes or accommodation are not considered as
service changes as long as the changes are not substantial or don’t
compromise the entire layout of the booked tour.
Many things cannot be fully predicted or planned. We therefore count
on your understanding when necessary changes have to be made.
5 Participation
In participating in a cycling or walking tour with Mad-bike Madrid
the client is aware of the fact that these activities have an
inherent element of ‘risk’. It is obligatory that the client has
checked with his or her travel insurance policy to confirm that he
or she is covered to participate in the chosen activity.
Mad-Bike Madrid takes all necessary precautions to reduce the
element of risk during the activity. However, due to circumstances
that are impossible to foresee or control (Force Majeure*) or for
negligent behaviour on the part of the participant(s), Mad-Bike
Madrid can not be held responsible for any accident or incident that
may occur.
6. Identification
By Spanish Authorities you are obliged to have proper identification
present at all times. A passport that is valid for at least six
months is adequate.
7. Tour Cancellation
The client can withdraw from the tour at any time before the tour
begins, by giving a written explanation. Mad-Bike Madrid must
receive the written cancellation. In the event of a cancellation by
the client, the tour organizer will demand a cancellation fee, which
will be calculated according to the tour price:
From date of payment –
31 Days before tour start 30 % of the tour price.
30 - 15 days before tour start 40 % of the tour price.
14 - 7 days before tour start 60 % of the tour price.
6 - 0 days before tour start 80 % of the tour price.
Additionally you are at liberty to verify the claim. Rebooking of
dates are only possible via cancellation of your existing booking
and making an entirely new booking.
8. Cancellation by Tour Organizer
If there isn’t a minimum booking of four participants, Mad-Bike
Madrid can cancel the tour up to 30 days prior to tour begin. In
this case the client will immediately be informed and all payments
made will be reimbursed. Further claims fail to exist.
Should a tour have to be cancelled up to 30 days prior to tour begin
due to reasons beyond our control (violence, strikes, terrorist
attacks, accidents, illness of tour leader, catastrophes etc.) the
client will immediately be informed and all payments made will be
reimbursed. Further claims fail to exist.
We also reserve the right to discontinue a tour due to the above
mentioned reasons. In this case a partly reimbursement of the tour
price for the remaining part of the tour will be made. Further
claims fail to exist.
Individual participants can be excluded from the tour by the tour
organizer and its authorized tour guide due to undisciplined,
dangerous, or disturbing behaviour during the tour. He/she may also
be excluded if traffic regulations are not abided by. In such a
case, the rental bike will be seized and no reimbursement for the
tour will be given.
9. Liability
Mad-Bike Madrid shall be liable within due diligence of a
businessman for accurate tour preparations, careful monitoring and
selection of service providers and the usual tour contribution
agreed upon for the area.
Furthermore, Mad-Bike Madrid is not liable for any traffic
accidents.
In these situations each tour participant is responsible and liable
for his/her individual actions and especially for his/her driving
manner, route choice and self-assessment of his/her abilities, even
when following the tour guide.
Each tour participant agrees that the owners, organizers and
representatives of Mad-Bike Madrid are not responsible for his/her
personal safety and can not in any situation, whether individual or
collective, be held liable for incidents in connection with his/her
actions or participation in the tour which may lead to injury, death
or damages to his/her property, family, heirs or legal successors
10. Limitation of liability
The contractual liability of the tour organizer for damages that are
not bodily injury, is limited to three times the tour price, so far
as the damage to the client wasn’t intentionally or grossly
negligent, or where the organizer is responsible for damages only
due to fault of a service provider. A liability due to delay is
excluded.
11. Liability and Weather
Depending on the season and weather conditions, Mad-Bike Madrid
reserves the right to make changes if necessary to the tour route,
and schedule. We strive not to change the character of the tour and
to offer the same services.
The organizer can not be held responsible for any unfavourable
weather conditions. Therefore the participant cannot claim
reimbursement for the tour due to weather conditions.
12. Reclamation
In the event of service failure the participant is obligated to do
everything within reason to minimize the damage. Should you have
reason for reclamation despite the care taken while planning and
executing the tour, we ask that you inform us immediately. You can
reach us during normal business hours. Additionally we ask that all
claims be made within one month after tour end. After this time all
claims are only effective if you were, by no fault of your own, kept
from making the claim within the stipulated time. Any warranty
claims can only be effective if made by the participant, and cannot
be transferred to another person.
13. Miscellaneous
The nullity of an individual clause in the contract does not nullify
the entire contract. The same applies to the current terms and
conditions. All previously published terms and conditions are
replaced by the available conditions and thereby lose their legal
effectiveness.
